An Employee wants to discontinue his contract immediately, that was 3 months before the expiry of his contract with the Company. The Employer threatens him that he cannot discontinue the contract unless he serves 1 month notice and he is liable to compensate the Employer the remaining 3 months of his salary.

The Employee is advised to refer to his employment contract as a point of reference. In usual circumstances, the Employee is only required to provide 1 month notice to the Employer or payment of 1 month salary in lieu of such notice. Nevertheless, such circumstances may vary depending on the clauses of his employment contract.
