First and foremost, there is never any copyright protection for use of language unless it is some form of literary work like books and publications and the use of which is not permitted.
Website terms and conditions and privacy policy are now generic and functional use of the language thus no copyright to be claimed. Furthermore, to take action would be futile too for the originator.
Generally, there is not much difference whether it is under the law of the USA or the law of Malaysia. Tailor-made in fact require better understanding of your unique situation.
