Ah Leong has been staying in a bungalow house in Kuantan, Pahang for more than 40 years. However, Ah Leong wasn’t the owner of the house. The house was previously owned by his great grandfather but later given to a company named XYZ Sdn Bhd, a well known housing developer.

The company, XYZ Sdn Bhd now wants to claim back the house and Ah Leong was given a thirty (30) days notice to leave the house. Ah Leong thinks he is the rightful owner of the house despite his name was not registered under the land title.

According to section 48 of National Land Code, no title to State Land shall be acquired by possession, unlawful occupation or occupation under any licence for any period whatsoever.

Although Ah Leong has been staying in the bungalow house for more than 40 years, he is still not entitled to claim the title on the basis that he has been occupying the house for such a long period of time.
